01. General Provisions
Article 1 (Purpose) These Terms and Conditions are intended to define the basic terms and procedures for the use of all services (hereinafter referred to as “Services”) provided by Samyang Foods Co., Ltd. (hereinafter referred to as the “Company”) through its website (www.buldak.com). A user is defined as a person who receives the Services provided by the site in accordance with these Terms.
Article 2 (Effect and Amendment of the Terms)
- These Terms become effective when notified to users through the Service or by email.
- The Company may amend these Terms, which shall become effective in the same manner as stipulated in paragraph 1.
Article 3 (Governing Rules Outside the Terms) Matters not specified in these Terms shall be governed by the Framework Act on Telecommunications, the Telecommunications Business Act, and other applicable laws and regulations.
02. Service Use Agreement
Article 4 (Establishment of Use Agreement)
- When a user clicks the “Agree to Terms” button during service application, it is considered as agreement to these Terms.
- The use agreement is established when the Company approves the user’s application.
- If the user does not agree to the Terms, they may discontinue the service. Continued use after changes to the Terms constitutes acceptance of the changes.
Article 5 (Loss of User Qualifications) The Company may limit, suspend, or revoke a user’s membership if they fall under any of the following:
- False information was provided during service application
- Disruption of other users’ service use or theft of their information, threatening electronic transaction order
- Application for service with the intent to harm public order or morals
- Failure to meet other requirements specified by the Company
Article 6 (Service Application)
- To use the Services, users must fill out the required information in the Company’s designated application form for each service.
- All user information provided in the application form is considered actual data. Users who provide false information are not protected by law and may be restricted from the Service.
Article 7 (Acceptance of Application)
- The Company will approve applications unless they violate Articles 4, 5, or 6.
- The Company may delay approval in the following cases:
- Technical difficulties
- Other circumstances deemed necessary by the Company
- The Company may reject applications in the following cases:
- If the information is not the user’s own
- If false information was provided
- If the purpose of application harms public order or morals
- If the application does not meet the Company’s requirements
- If the applicant is under 14 and lacks parental consent
Article 8 (Changes to User Information) Users must manage their information responsibly. If any changes occur, users must notify the Company. The user is responsible for issues arising from failure to update their information.
03. Obligations of the Parties
Article 9 (Obligations of the Company)
- The Company shall provide the Services continuously and stably in accordance with these Terms.
- The Company shall not disclose or distribute users’ personal information to third parties without consent or use it for commercial purposes unrelated to the Service, except in the following cases:
- Upon request by national institutions under applicable laws
- When provided in an unidentifiable form for statistical or market research purposes
- When shared with business partners or affiliates to provide better services
- The Company may provide information it deems necessary during service use via text, email, or mail, based on the user’s application.
Article 10 (Obligations of Users)
- Users are responsible for the management of their information and for consequences of its misuse.
- Users must notify the Company of any misuse or security violations regarding their personal information.
- Users must comply with applicable laws, these Terms, and service usage guidelines.
- Users may not conduct commercial activities using the Service without the Company’s prior approval.
04. Provision and Use of Services
Article 11 (Scope of Service) These Terms apply to all services provided by the Company. Supplementary terms may apply to services requiring special provisions.
Article 12 (Provision of Information) The Company may provide users with necessary information via email or mail. Users may opt out by notifying the Company.
Article 13 (Transactions with Advertisers) The Company is not responsible for any loss or damage arising from users’ transactions with advertisers on the site or through the Service.
Article 14 (Service Hours) In principle, the Service is provided 24/7 year-round, unless technical or operational issues occur. Service may be restricted in cases such as:
- Regular maintenance
- Facility failure
- Service overload
- Suspension of telecommunication services by carriers
- Natural disasters or other force majeure events
Article 15 (Responsibility for Use of Services) Users may not use the Service for illegal sales or activities such as hacking, advertising, operating adult sites, or distributing pirated software. The Company is not liable for any legal consequences or damages caused by such activities.
Service may be restricted in cases involving:
- Disruption to service operation
- Criminal activities
- Infringement of intellectual property rights
- Violation of relevant laws
05. Membership
Article 16 (Definition and Registration of Members)
- A “member” is an individual who agrees to these Terms, provides required personal information, and completes the registration process to use the Company’s services.
- Members must provide accurate information and must not impersonate others or submit false information.
- The Company may reject applications in the following cases:
- Use of another person’s identity
- Submission of false information
- Significant disruption to service operation
Article 17 (Withdrawal and Disqualification of Members)
- Members may request withdrawal through Customer Center or My Page, and the Company will promptly process it.
- The Company may restrict or revoke membership in the following cases:
- False information during registration
- Interference with other users or information theft
- Intentional disruption of operations
- Violation of laws or these Terms
Article 18 (Modification and Management of Member Information)
- Members must promptly update their information and the Company is not liable for disadvantages caused by failure to do so.
- Members are responsible for managing their account and password, which must not be transferred or shared.
- If account misuse is discovered, the member must notify the Company. The Company is not responsible for damages due to delayed reporting.
Article 19 (Email Verification and Account Protection)
- The email address provided during registration is used for verification and notifications. The Company may conduct email verification.
- Accounts without email verification may have limited access to Services.
- If email account misuse is discovered, the user must notify the Company. The Company will take protective measures.
Article 20 (Protection of Children’s Personal Information)
- The Company does not permit users under 13 to register without parental consent.
- If it is confirmed that a user is under 13, the account may be restricted or deleted under applicable law.
- Collection of children’s personal information follows procedures in the [Privacy Policy].
06. Others
Article 21 (Compensation for Damages) The Company is not responsible for any damages arising from the use of the Service.
Article 22 (Disclaimer)
- The Company is not liable for failure to provide the Service due to force majeure such as natural disasters.
- The Company is not responsible for damages arising from information obtained from the Service or responses from experts.
- The Company is not liable for failure to achieve expected benefits or for damages from selective use of service materials.
- The Company is not responsible for the accuracy or reliability of user-posted content.
Article 23 (Jurisdiction) In the event of litigation related to the Service, the court with jurisdiction over the Company’s location shall have jurisdiction.
